Cash Wages and Underreported SGK Contributions in Turkey: Correcting Employment Records

Review of payroll and social-security records representing underreported SGK earnings

When only the minimum wage is transferred to a bank account and the balance is paid in cash, or a fully worked month is reported with missing days, the issue extends beyond today’s salary. Inaccurate records may affect social-security rights and future calculations. First identify what is wrong: insurance days, the starting date or earnings subject to contributions? This guide concerns employees insured under category 4/a in Turkey.

Do not directly equate net salary with earnings subject to contributions

The contribution-based earnings shown on e-Devlet are not the same as the net wage paid into your bank account. Gross salary, statutory deductions, included payments, exemptions and the contribution ceiling must be considered together. A difference between two figures therefore does not alone prove underreporting. However, where actual gross wages or other payments subject to contributions are understated, the missing declaration requires investigation.

Reporting fifteen days despite full-time work differs from reporting thirty days with understated earnings. Part-time arrangements, unpaid leave, medical leave, joining or leaving during a month and the circumstances of the relevant period can affect the day count. Compare the actual work with the basis of the declaration rather than assume every month must always show thirty days.

Which e-Devlet records should you check?

  • Compare the employer, month, insurance days and contribution-based earnings on your SGK registration and service statement.
  • Record the reported starting and leaving dates separately from the dates actually worked.
  • Identify months with missing days and the related leave, medical or contractual documents.
  • Match bank statements, payslips and the actual pay agreement month by month.
  • Keep dated copies rather than relying on today’s screen, and track subsequent corrections.

What evidence can establish cash-paid wages?

Correspondence containing the pay offer, signed wage documents, regular cash-payment schedules, payment messages and bank records may be relevant. Comparable-pay research based on occupation, seniority and duties may help, but an online salary table does not conclusively establish your actual wage. Identify which period and payment practices colleagues directly know. Evidential requirements may differ between wage claims, insured service periods and contribution-based earnings.

Do not claim cash already received as if it were unpaid salary. The purpose is to establish the true wage and the recording shortfall, not to conceal payments. Social-security declarations may be inaccurate even if the wage was paid in full. An employer’s statement that accepting cash prevents you from correcting insurance records does not by itself constitute a valid waiver of social-security rights.

Applying to SGK and investigation

In an application to the relevant social-security office, specify the employer’s name, workplace address, working dates, disputed months and available documents. ALO 170 also provides information and a complaint channel. Keep the application reference and response. Acting promptly while employment continues may matter for inspection of the actual working arrangements. A complaint does not automatically result in correction or a direct payment to the employee.

Contributions recovered from an employer following an SGK investigation are different from unpaid wages payable to the employee. Salary or compensation claims must be assessed separately against the employer. Correcting social-security records and recovering money may draw on the same evidence while requiring different legal procedures.

Understand the five-year period for service determination

Article 86 of Law No. 5510 generally provides a five-year period, running from the end of the year in which the work occurred, for proceedings to establish service where required documents were not submitted or the work was not identified by SGK. This differs from the limitation period for ordinary wage claims. Notifications, SGK’s knowledge of the employment and continuity of service may affect the time-limit analysis and possible exceptions.

Missing days, wholly undeclared employment and understated earnings should not automatically be treated as sharing one identical deadline. Do not assume that complaining to ALO 170 preserves the period for court proceedings. Prepare a timetable based on working years, notifications and the nature of the claim. Leaving the issue until retirement can lead to lost evidence and missed deadlines.

Mediation or the labour court?

Determination of compulsory insurance and insured service periods is not an ordinary monetary employment claim that the parties can freely waive or settle. The mediation procedure for wage claims cannot be used to settle away the obligation to record insured service correctly. Article 4 of Law No. 7036 excludes determination of compulsory insured service under an employment contract from the requirement to apply to SGK before bringing proceedings. Other social-security disputes require separate assessment of that preliminary-application rule.

Unpaid wage and employment compensation claims, by contrast, generally require mediation before court proceedings. Where both correction of records and payment are sought, separate the claims and use the appropriate procedure against the correct parties. If you are considering leaving, the consequences of underreporting for justified termination and the wording of any notice also require assessment; do not simply stop attending work.

Frequently asked questions

I received my full salary. Can I still seek correction?

Full payment and accurate social-security declarations are separate obligations. If days or earnings are reported incorrectly, correction routes can be considered.

The employer corrected the record. Is the matter resolved?

Check which months, days and earnings were corrected. Completing the day count does not necessarily mean disputed wages or contribution-based earnings were corrected too.

Will a finding of underreporting definitely increase my pension?

Pension calculations depend on service periods and social-security rules. A specific increase or outcome cannot be guaranteed without examining the records and calculation.
