Tera Portföy Fund Losses: When Can an Investor Claim Compensation?

Yatırım fonu zararı ve sorumluluk konulu temsili görsel

A drop in your fund’s value and a failure to pay redemption proceeds may give rise to different legal questions. Following the September 2026 developments concerning Tera Portföy funds, investors should distinguish liquidation entitlements from a possible compensation claim.

Does a price fall itself create a claim?

A fund can lose value without any unlawful conduct. Investment risk materialising does not automatically establish liability. Allegations of misleading information, a breach of contract or a manager’s failure to fulfil duties require specific supporting records. SPK regulation does not amount to a government guarantee of capital or return.

Whose conduct should be examined?

The fund founder, portfolio manager, distributor bank or investment firm and custodian perform different functions. Buying through a bank does not make that bank responsible for every subsequent loss. Information given at purchase, risk disclosures, any personalised recommendation and order handling require separate analysis. Identify the legal entity responsible for the alleged conduct rather than treating all companies within a group as interchangeable.

How should the loss be documented?

Separate the difference between purchase cost and current value, unpaid redemption proceeds and any additional loss allegedly caused by delay. Record which statement influenced your decision and how it connects to the loss. Preserve dated originals of advertisements and messages. Later partial payments must be included in the calculation; the same loss cannot be recovered twice.

How do liquidation, complaints and litigation interact?

An SPK complaint seeks regulatory scrutiny and does not award damages. A liquidation payment neither proves nor automatically removes a separate liability allegation; settlement and release documents require individual review. Before litigation, assess jurisdiction, the parties’ legal capacities, mediation requirements and limitation periods. Do not assume that an SPK or CİMER application suspends every deadline for bringing a claim.

What can you share with JURIVEX?

The fund code, purchase and redemption orders, payment status and a summary of statements made when you invested help with an initial assessment. The records determine which claim may be directed against which entity. Assuming that every affected investor should bring the same action can overlook important differences between funds and transactions.

How to organise your application file

Set out events chronologically and match each payment, instruction and reply to its record. Keep original files and capture screenshots with dates and URLs. Retain proof of delivery for written applications. If a statement changes, preserve the earlier version as well. Avoid publishing identity and account information on public channels.
