Statements such as “Write a resignation first and we will pay your compensation” or “This is only for accounting” can conceal significant consequences. Resignation, mutual termination, a payment receipt and a mediation settlement do not have the same legal effect. Before signing, identify the transaction; if you have already signed, preserve a copy and evidence of the process. These explanations concern private-sector employment relationships under Turkish law.
Resignation, mutual termination and release: three different acts
A resignation is the employee’s declaration terminating the employment contract. A mutual termination agreement, known in Turkey as an ikale, ends it by agreement. A release, or ibraname, seeks to discharge specified liabilities. All three may appear in one file. The substance, circumstances and genuine intention matter more than the document’s title. A promise not to bring reinstatement proceedings differs from a receipt confirming only that a particular amount was received.
A genuine resignation also differs from an allegation that an employer-prepared form was signed under pressure. Leaving for a justified reason because wages were unpaid may have different severance and notice consequences from resigning for personal reasons. Signing an inaccurate “personal reasons” statement merely because payment has been promised may make the true circumstances harder to prove.
When is an employee’s release valid?
Article 420 of the Turkish Code of Obligations provides special protection for an employee releasing claims against an employer. The agreement must be written, at least one month must have elapsed since termination, the type and amount of each claim must be expressly stated, and full payment of the entitlement must be made through a bank. A release failing these conditions is absolutely void. An ordinary release signed on the last day of employment therefore requires particular scrutiny.
A document recording less than the full entitlement may have the effect of a receipt for a payment made through a bank; that does not mean every unpaid balance disappears. The one-month rule does not permit the employer to postpone paying accrued salary or other debts for a month. The duty to pay and the legal effect of a release are separate issues.
Do not assess a mutual termination offer only by the extra payment
Who proposed the arrangement, the employee’s free will and whether there is a reasonable benefit in the particular circumstances are important. There is no universal number of additional monthly salaries that validates every ikale. Severance and notice equivalents, unused leave, unpaid wages and additional benefits should be shown separately. Eligibility for unemployment benefit depends on the actual manner of termination and İŞKUR requirements; an employer’s verbal assurance is not a guarantee.
A mediation settlement is not an ordinary release
Resolving a genuine dispute through mediation differs from attaching a “mediation” heading to exit paperwork. A properly concluded mediation settlement is governed by special rules on binding effect and the inability to litigate matters already agreed. It is therefore incorrect to treat every mediation settlement as automatically invalid because Article 420 requires a one-month interval for an ordinary release. Allegations of pressure, defective consent or the absence of a genuine mediation process may nevertheless require specific investigation.
- Read each entitlement and period covered by the settlement.
- Check gross and net amounts, deductions, payment dates and instalments.
- Ensure that you actually participate and can explain your claims freely.
- Ask for clarification of any waiver or broad statement that no other entitlements remain.
- Obtain signed copies of the final record and settlement; do not sign blank documents or forms to be completed later.
First steps if you signed under pressure
Preserve the signed documents, bank movements, offer messages and meeting invitations. Write a chronological account of when pressure was applied, who was present and what was said. Identify people who know the events. Earlier correspondence showing an intention to dismiss, or messages attaching a prepared resignation, may help establish the true manner of termination. Preserve existing evidence without unlawful recording or access.
The document type and available challenge must then be assessed. Mistake, deception or duress, invalidity of a document and reinstatement are not governed by a single deadline. Do not assume that sending the employer a message saying “I do not accept” preserves all rights. If reinstatement protection applies, the one-month mediation period from notification of dismissal may also be relevant. Keep that timetable in view while the nature of a signed resignation is disputed.
How should you evaluate a payment offer?
Separate undisputed debts, disputed claims and the additional benefit offered for settlement. Ask which salary and service period were used in the calculation. A total figure with no definite payment date differs from money already credited to your bank account. Reviewing the documents should clarify not only the amount, but also which transaction closes which claim and what happens if payment is not made.
Frequently asked questions
I signed. Does that mean nothing can be done?
Not automatically. The type of document, validity requirements, genuine intention, payment and deadlines must be examined together. Equally, the signature cannot simply be ignored.
Is “all entitlements” in a transfer description sufficient?
The bank-transfer description alone does not establish that every claim has ended. The payment’s nature and amount and the scope of any valid settlement need assessment.
Can I ask to take the document away for review?
Requesting a copy and obtaining legal assistance helps you understand the consequences. Do not sign an inaccurate or blank document as a condition for payment.
